These terms and conditions (Terms) apply to the website, applications and other online services (Services) of Teach This Pty Ltd ABN 65 129 713 015 (Teach This, we, us, our), including all subscriptions for membership (Membership) and all purchases of digital and physical products made through the Services.
By using the Services, registering for Membership or making a purchase, you agree to these Terms.
1.1 You do not need to register for Membership to make one-off purchases of products through the Services.
1.2 Teach This currently offers the following types of Membership:
(a) Free Membership: free registration providing access to a limited selection of sample resources chosen by Teach This from time to time, and a small monthly allowance of AI credits;
(b) Standard Membership: an annual paid Membership for a single user, providing access to the full Teach This resource library and a monthly allowance of AI credits;
(c) Pro Membership: an annual paid Membership for a single user, providing everything included in Standard Membership with a larger monthly allowance of AI credits, priority generation at times of high demand, and any other inclusions described on the Services for Pro Membership; and
(d) School Membership: an annual paid Membership purchased by or for a school, providing a Standard Membership for each teacher whose email address is nominated on the account (nominated users). A School Membership requires a minimum of eight nominated users, which includes the person who manages the account for the school (School Administrator). The School Administrator may manage the school's Membership, including its nominated users and associated account administration, but does not automatically have access to the individual content or activity within another nominated user's account. The Membership Fee for a School Membership is based on the number of nominated users.
1.3 For School Memberships, the school may update its nominated users during the Membership Period (for example, when staff change) by updating the nominated email addresses on the account or by contacting us. The number of nominated users must not at any time exceed the number covered by the Membership Fee paid. Each nominated user has their own individual account, and nothing in one nominated user's account is shared with another.
1.4 Teach This may modify, remove or introduce Membership types from time to time. Any change will not reduce the access you have paid for during a current Membership Period, except as set out in clause 18.3.
1.5 When you register, you must provide accurate and current information and keep it up to date. You are responsible for keeping your login credentials secure, including any password, login link or login code we send you, and you must notify us promptly if you become aware of any unauthorised use of your account.
1.6 Each account may be logged in on no more than three devices at the same time. Logging in on another device may log out the earliest active session.
1.7 You may hold a primary and a secondary email address on your account (for example, a school address and a personal address). Login links are sent only to email addresses on your account, so please keep them up to date. If you lose access to the email addresses on your account, contact us and we will verify your identity before updating them.
2.1 A paid Membership grants you a licence, for the duration of your Membership Period, on the following terms:
(a) Single-user Memberships (Standard and Pro): the licence is personal to you as a single user. You may download, print, display and use Teach This resources to plan for and teach the students in your own class or classes (including in relief, support, specialist and home education settings).
(b) School Memberships: each nominated user under the School Membership receives the same licence as a single user. The licence does not extend to staff who are not nominated users.
2.2 Where a resource is provided in an editable or fill-in format, you may complete, assemble and adapt it as the resource is designed to be used in your own teaching. You must not otherwise alter Teach This resources, and you must not remove any Teach This branding or copyright notices.
2.3 You must not:
(a) share your login credentials with any other person, including by forwarding or sharing any password, login link or login code, or otherwise allow any other person to access your Membership;
(b) share, distribute, sell, license or give access to Teach This resources to any person other than the students you teach (and their parents or carers where a resource is designed to go home with students);
(c) upload Teach This resources to any school shared drive, intranet, learning management system or storage service in a way that gives access to people who are not covered by your licence;
(d) publish Teach This resources on any website, marketplace or social media platform, list or sell them (or any resource copied from or substantially based on them) on any online teaching resource marketplace, or submit them to any other resource-sharing service;
(e) use, reproduce, extract, copy, adapt or otherwise exploit Teach This's resources, AI-generated content or any part of the Services, whether directly or indirectly, to train, develop, fine-tune, test, evaluate or improve any artificial intelligence or machine learning model, system, algorithm or dataset;
(f) use Teach This's resources or content to create or contribute to any dataset intended for the development, training or improvement of an artificial intelligence or machine learning system, or provide, make available or permit any third party to use Teach This's resources, AI-generated content or any part of the Services for any of these purposes; or
(g) use automated tools, bots, scripts, scraping technologies or other systematic methods to access, collect, extract or download Teach This's resources or content, except through functionality expressly provided by Teach This.
2.4 Your licence is for non-commercial educational use only. All resources you download remain the intellectual property of Teach This (see clause 13). Your licence ends when your Membership ends.
2.5 You are responsible for any use of your Membership by any person you allow to access it.
3.1 The fee for each paid Membership (Membership Fee) is published on the Services and is stated in Australian dollars inclusive of GST (where applicable).
3.2 The Membership Fee is payable in advance and covers a period of 12 months from the date your Membership starts (Membership Period).
3.3 We may change Membership Fees from time to time. A fee change will not affect a Membership Period you have already paid for. It applies only from your next renewal, and the current fee will always be displayed before you renew.
3.4 Payments are processed by third-party payment providers. We do not store your full payment card details.
3.5 From time to time we may run promotions, discounts or special offers. Each promotion is valid only during the promotional period we state, and only on the terms stated for that promotion. A promotion cannot be applied to purchases made before or after the promotional period, cannot be combined with any other offer unless we say so, and is not redeemable or exchangeable for cash.
3.6 A Membership purchased during a promotion starts on the date of purchase and runs for the standard Membership Period from that date. The start of a Membership cannot be deferred to a later date, whether purchased at a promotional price or otherwise.
3.7 Unless a promotion expressly states otherwise, promotional pricing applies only to the initial purchase it is stated for, and any renewal is at the then-current standard Membership Fee. We may withdraw, extend or vary a promotion at any time, but this does not affect a purchase you have already completed.
3.8 You may upgrade from Standard Membership to Pro Membership at any time. You pay the difference in Membership Fee for the remainder of your current Membership Period, the upgrade takes effect immediately, and your renewal date does not change.
3.9 You may change from Pro Membership to Standard Membership with effect from your next renewal. Pro Membership inclusions continue until the end of your current Membership Period.
4.1 Your Membership expires at the end of your Membership Period unless it is renewed.
4.2 We will send you renewal reminders before your Membership expires.
4.3 If your Membership expires without renewal, your access to member resources and AI tools will stop. Resources you have already printed for use in your own teaching are not affected, but your licence to download, access and use digital files ends with your Membership.
4.4 Paid Memberships purchased or renewed through our checkout renew automatically unless you turn auto-renewal off. This is shown clearly at checkout before you pay. While auto-renewal is on, your Membership will automatically renew for a further 12-month Membership Period at the end of each Membership Period, and the then-current Membership Fee will be charged to your nominated payment method up to 3 days before the end of your current Membership Period, so your access continues without a break. The new Membership Period starts when the current one ends. We will send you a reminder, including the renewal fee, at least 14 days before each renewal date. You may turn off auto-renewal at any time before your renewal date through your account settings or by contacting us, in which case your Membership will simply expire at the end of the current Membership Period. Auto-renewal also turns off if you remove your payment card from your account. If your Membership began before automatic renewal was introduced, it will not renew automatically until you next pay through our checkout or switch auto-renewal on in your account settings.
4.5 Purchased AI credits (see clause 6.4) can only be used while your Membership is active. When your Membership ends, any purchased AI credits remaining in your account are held for 12 months. If you pay for a new Membership within those 12 months, they are returned to your account. After 12 months, they are forfeited. While you do not have a paid Membership, you receive the monthly allowance of AI credits included in Free Membership. Purchased AI credits are subject to these expiry arrangements, without limiting any rights or remedies you may have under applicable consumer protection laws.
4.6 You may cancel your Membership at any time through your account settings or by contacting us. When you cancel, automatic renewal is turned off and you keep full access, including the AI planning tools, until the end of your current Membership Period. Your Membership then expires, and any purchased AI credits are held as set out in clause 4.5. Cancelling does not entitle you to a refund, except as set out in clauses 11, 18.3 and 19.
5.1 Paid Memberships include a monthly download limit of 400 resources per user. If you reach this limit in a month, downloads resume at the start of the next month. The limit cannot be reset or increased within a month.
6.1 Memberships include access to AI planning tools on eligible resources, such as detailed lesson plans, lessons within a unit series, learning intentions and differentiation guides. Each lesson plan, and each lesson within a unit series, uses one AI credit when it is generated. Rewriting a single lesson plan uses one AI credit.
6.2 Each Membership type includes a monthly allowance of AI credits (included credits), as published on the Services from time to time. For School Memberships, each nominated user has their own included credits, and credits are not pooled between nominated users. Some tools, such as differentiation guides, learning intentions, assigning online practice and viewing the planned sequence for a unit, do not use AI credits.
6.3 Your included credits reset on the 1st of each month. Unused included credits do not carry over to the next month.
6.4 Paid Members and nominated users may buy top-ups of additional AI credits (purchased credits). Purchased credits do not expire from month to month and remain available while your Membership is active (see clause 4.5). Free Members cannot buy top-ups.
6.5 From time to time we may give you bonus AI credits (bonus credits), for example as part of a promotion. Bonus credits may have an expiry date, which we will tell you when we give them.
6.6 AI credits are used in this order: your included credits first, then bonus credits (earliest expiry first), then purchased credits.
6.7 An AI credit is only used when generation completes successfully. A generation that fails does not use any AI credits. Once a generation starts, it finishes and is saved to your account even if you close your browser.
6.8 To keep the Services fast and fair for everyone, we may apply reasonable fair use limits, such as a limit on the number of generation requests in a short period.
6.9 Some tools include a follow-up chat. Follow-up chats exist only for the session in which they take place, are not saved to your account, and may be limited to a set number of follow-up questions per session.
6.10 We may increase included credits at any time. We will not reduce the included credits for a Membership Period you have already paid for, except as set out in clause 18.3.
7.1 Content generated by the AI planning tools is created automatically from Teach This resources and the information you provide. While we design these tools carefully, generated content may contain errors or may not suit your class. You are responsible for reviewing generated content and using your professional judgement before using it in your teaching.
7.2 You must not enter the name or any other identifying information about a student, or about any other person, into any AI planning tool. Describe needs in general terms instead.
7.3 Information you enter into the AI planning tools is processed by our AI service provider to generate your content, which may involve processing outside Australia. We handle this information in accordance with our Privacy Policy.
7.4 You may use generated content under the same licence as Teach This resources (see clause 2). Generated content must not be shared, sold or published outside that licence.
8.1 Some resources let you assign online practice to your students. Online practice is delivered through a link that you share with your students. Students do not need an account, and no student names or other identifying information are collected.
8.2 Practice links may expire after a set time. You are responsible for sharing practice links only with the students you teach.
8.3 Results from online practice are shown to you as class-level summaries and are not linked to any named student.
9.1 Membership provides access to the resources and content Teach This makes available from time to time for your Membership type. We regularly add, update and retire individual resources, and we may modify or remove specific content at any time.
9.2 If we make a change during your paid Membership Period that materially reduces the overall content or features you paid for, clause 18.3 applies.
9.3 We do not guarantee that the Services will be accessible on any particular device, browser or network. Teach This is not responsible if a department of education or similar authority restricts access to the Services on its networks or devices.
10.1 Prices for physical products are published on the Services in Australian dollars inclusive of GST (where applicable). Shipping costs are shown at checkout before you pay.
10.2 Physical orders are generally dispatched in a weekly dispatch run, so please allow up to 7 days from payment for your order to be dispatched. In-stock planners are usually dispatched by the next business day. Delivery timeframes shown at checkout are estimates provided by our delivery partners, not guarantees, but we will take reasonable steps to have orders delivered within a reasonable time.
10.3 Please check your delivery address carefully at checkout. If an order is not delivered because you provided an incorrect or incomplete address, we may charge you the actual cost of re-shipping the order.
10.4 Title to physical products passes to you on payment in full. Risk passes to you on delivery.
10.5 If a physical product arrives damaged, is faulty, or does not arrive due to loss in transit, contact us and we will provide the remedy you are entitled to under the Australian Consumer Law. For a major failure, that is your choice of a replacement or refund (see clause 19).
11.1 Nothing in these Terms excludes your rights under the Australian Consumer Law. Where a product or service we supply fails to meet a consumer guarantee, you are entitled to the remedies set out in clause 19.
11.2 We do not offer refunds or returns for change of mind or accidental purchase. This applies to Memberships, AI credit top-ups, digital products and physical products. Please choose carefully. If you contact us promptly about a genuine mistake we will consider it in good faith, but we are not obliged to provide a refund where the law does not require one.
12.1 You must not use the Services or any content on the Services:
(a) for any unlawful purpose, or to solicit others to perform any unlawful act;
(b) to infringe or violate any person's rights, including intellectual property rights and privacy;
(c) to harass, abuse, insult, harm, defame, intimidate or discriminate against any person;
(d) to submit false or misleading information;
(e) to upload or transmit viruses or other malicious code, or to interfere with the security or operation of the Services; or
(f) to access the Services by automated means (such as scripts or scrapers), or to try to get around download limits, AI credit limits or fair use limits.
13.1 All material provided through the Services, including text, images, code, photographs, illustrations, artwork, graphics, names, logos, trade marks, videos, music, animations, presentations, unit plans, lesson plans, AI-generated content and teaching content, is the property of Teach This or its licensors and is protected by copyright, trade mark and other intellectual property laws.
13.2 Except as permitted by your licence under clause 2 or with our prior written consent, you must not alter, reproduce, reverse engineer, store in a retrieval system, transmit, distribute, sell, publish, broadcast or circulate any material from the Services.
14.1 We take care to ensure the information and resources on the Services are accurate, but we do not promise that everything on the Services is complete, current or error-free at all times. Subject to clause 19, any reliance you place on material on the Services is at your own risk.
14.2 We may update the Services at any time, but we are not obliged to update any particular content.
15.1 The Services may contain links to external websites that are not controlled by Teach This. We are not responsible for the content or currency of any linked site, and a link does not imply our endorsement of, or any relationship with, the linked site or its operator.
16.1 Where the Services allow you to submit, post, publish or upload content, such as comments, reviews, feedback, photos or other material (Submitted Content), you grant Teach This a non-exclusive, royalty-free, perpetual licence to use, edit, copy, publish, distribute and translate that Submitted Content in any medium.
16.2 We are under no obligation to keep Submitted Content confidential, pay compensation for it, or respond to it. We may (but are not obliged to) monitor, edit or remove Submitted Content that we consider unlawful, offensive, defamatory, obscene or otherwise objectionable, or that infringes any person's intellectual property rights.
16.3 You are responsible for your Submitted Content. You warrant that it does not infringe any person's rights (including copyright and privacy), is not defamatory or otherwise unlawful, and contains no viruses or other malicious code. You must not use a false email address or impersonate any person.
17.1 We may send you marketing communications about Teach This, including new resources, teaching tips, special offers and other updates from Teach This and its related brands, where you have provided your consent or where we are otherwise permitted to do so by law. You can unsubscribe from marketing communications by using the unsubscribe link included in our emails. Once you unsubscribe, we will stop sending you marketing communications, subject to any communications we are legally permitted to send. Unsubscribing from marketing communications will not affect essential communications.
17.2 We handle your personal information in accordance with our Privacy Policy, available on the Services.
18.1 If you commit a serious breach of these Terms, including sharing your login credentials or login links, or distributing, publishing or on-selling Teach This resources, we may suspend or cancel your Membership immediately.
18.2 For any other breach, we will give you a written warning and a reasonable opportunity to fix the breach. If you breach these Terms again after a warning, we may suspend or cancel your Membership.
18.3 We may update these Terms from time to time by publishing the updated Terms on the Services. If we make a material change, we will give you reasonable notice (for example, by email or a notice on the Services). If a material change, or a change to your Membership content under clause 9.2, is detrimental to you, you may cancel your Membership within 30 days of the change taking effect and receive a pro-rata refund of the Membership Fee for the unused portion of your Membership Period. Your continued use of the Services after notice of a change constitutes acceptance of that change.
18.4 If we cancel your Membership for breach under clause 18.1 or 18.2, you are not entitled to a refund of any part of the Membership Fee, except as required by law.
19.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value.
19.2 You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.
19.3 You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
20.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
20.2 Subject to clause 20.1, the Services are provided "as is" and "as available", and we do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.
20.3 Subject to clause 20.1, and to the maximum extent permitted by law, Teach This and its directors, officers, employees, agents, contractors and suppliers are not liable for any indirect, incidental, special or consequential loss or damage (including loss of data or loss of profits) arising from your use of, or inability to use, the Services or any products obtained through the Services, whether based in contract, tort (including negligence), statute or otherwise. This includes, without limitation, loss of profits, revenue, business opportunities or data.
20.4 Where our liability for breach of a consumer guarantee can be limited under section 64A of the Australian Consumer Law, our liability is limited, at our option: for services, to resupplying the services or paying the cost of resupply; and for goods, to replacing or repairing the goods, or paying the cost of replacement or repair.
21.1 You indemnify Teach This and its officers, employees, agents and contractors against any loss, damage, claim or expense (including reasonable legal costs) suffered or incurred by them to the extent it is caused by your breach of these Terms or your violation of any law or the rights of any third party. This indemnity does not apply to the extent the loss is caused by Teach This's negligence.
22.1 These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
22.2 If any part of these Terms is found to be invalid or unenforceable, that part is severed and the remainder of these Terms continues in effect.
22.3 A failure by Teach This to enforce any part of these Terms is not a waiver of that or any other right.
22.4 You may not assign your rights under these Terms without our written consent. These Terms, together with our Privacy Policy, are the entire agreement between you and Teach This in relation to the Services.
